Terms of sale

These terms are informational for customers — not a substitute for a solicitor’s review, and not legal advice about your hiring decisions.

1. Who we are

These terms are between you and Ellis Greensitt, a sole trader trading as VacancyCheck (“we”, “us”). Email: hello@vacancycheck.co.uk. No telephone. These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that a consumer may also bring a claim in the courts of their UK home nation.

2. What we sell

We sell informational digital job advert wording checks (wording risk reports) for UK job vacancy ads:

• Free limited check — one limited on-screen flag set per verified email per rolling 7 days (when the check API is live).
• Full report PDF — £9.99 one-off for one vacancy draft.
• Subscription — £79.99 / month — up to 20 full PDF reports per calendar month; early renew allowed if the monthly cap is hit.

Primary customer input is pasted draft job-ad text. A live URL is optional and retrospective only.

We do not give legal advice, Equality Act clearance, or confirmation that a vacancy is safe to publish.

3. How to buy

Orders are placed via the website order page or by email. A contract is formed when the Stripe invoice is paid. Prices are in pounds sterling. We are not VAT-registered; VAT is not added. We may refuse a job and refund any payment taken.

4. Delivery

Digital supply: free checks return on-screen flags after email verification; paid full reports are sent as PDF by email. Subscription reports are counted against the calendar-month cap. Active subscribers access the subscriber desk with a single-use email magic link (no password); early renew is offered if the monthly cap is hit.

5. Consumers — 14-day cooling-off and digital content

If you buy as a consumer, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days to cancel a distance contract, starting the day after the contract is made.

Reports are digital content. If you ask us to start work and deliver during those 14 days, we will only do so if you make an express request and acknowledge that you will lose the right to cancel once supply of the digital content has begun. Ticking the order-form box is treated as that request and acknowledgement. Cancel by email to hello@vacancycheck.co.uk.

Nothing in these terms takes away mandatory consumer rights under the Consumer Rights Act 2015.

6. Business customers

If you buy in the course of business, you are not a consumer. The statutory cooling-off right in section 5 does not apply. We will still refund if a paid report is materially not as described.

7. Not legal advice / not Equality Act clearance

Every check and report is informational. Not legal advice. Not Equality Act clearance. Flags are heuristic / good-practice readings of the wording you supply. Clearance decisions stay with you and your advisers. We are not a solicitor, barrister, or equality consultancy.

8. Your material

You warrant that you may send us the draft text and any URL. Do not send confidential personal data of candidates that is not needed for the wording review.

9. Intellectual property

We own the copyright in the report. We licence you to use it inside your organisation for the named vacancy, including forwarding it to colleagues and advisers. You may not resell it.

10. Liability

We do not exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law. Subject to that, we are not liable for a decision to publish or withdraw a vacancy. For business customers, our total liability for a report is limited to the fee paid for that report (or, for subscription, the fee paid for the relevant month). We do not limit liability to consumers beyond what the law allows.
